Online talk examines key judgment

Hong Kong, 31 March 2023: A landmark Court of Appeal ruling concerning a personal injury claim, in which Boase Cohen & Collins represented the successful party, was analysed in a well-attended webinar.

In their presentation entitled “Solving the Riddle of ‘Accident’”, lead counsel Christina Lee of Denis Chang’s Chambers, supported by Jeffrey Chau and Bernard Lam from Parkside Chambers, outlined key points in the matter of Yu Kwok Wa suing by his next friend Lee Tsui Shan v China Telecom Global Ltd [2023 HKCA 75], a case where the Applicant asserted his stroke was attributable to work stress.

The Court of Appeal dismissed the Applicant’s claim for compensation and, in so doing, provided clearer direction in this area of law. BC&C represented the employer and instructed the three counsel who spoke at the webinar.

“This notable case aroused considerable interest among stakeholders in the insurance and personal injury sector and there was an excellent attendance for the webinar. We are grateful to Christina, Jeffrey and Bernard for giving their insights on the legal arguments put forward and the Court of Appeal’s ruling,” says BC&C Partner Jeffrey Chan, who oversaw his firm’s handling of the case.

The webinar was jointly organised by Denis Chang’s Chambers and the Hong Kong Federation of Insurers. The latter, established in 1988, actively promotes best market practices with an aim of improving the professionalism of, and strengthening public confidence in, the insurance industry.
