Hong Kong, 17 July 2026:<\/strong> A new total smoking ban at construction sites in Hong Kong takes effect immediately today, with no grace period. This marks an important and urgent compliance development for the construction industry, with the new regime intended to reduce fire hazards and improve occupational health and safety.<\/p>\n\n\n\n

Any person found smoking at a construction site commits an offence and is liable to a fixed penalty of HK$3,000. Contractors and subcontractors responsible for the site may also face liability if they fail to take all reasonable steps to ensure the site remains smoke-free, with a maximum fine of HK$400,000 upon conviction.<\/p>\n\n\n\n

The ban is based on three legislative amendments in the Legislative Council, including the Smoking (Public Health) Ordinance (Amendment of Schedule 2) Order 2026 (Amendment Order), the Fixed Penalty (Smoking Offences) (Specification of Authorities and Public Officers) (Amendment) Notice 2026 (Amendment Notice), and the Construction Sites (Safety) (Amendment) Regulation 2026 (Amendment Regulation). <\/p>\n\n\n\n

The new regime prohibits smoking across the whole construction site, rather than only in selected high-risk areas. The ban applies to construction sites broadly and extends to building maintenance sites, scaffolding, building exteriors, and renovation works, although occupied residential premises undergoing minor maintenance may fall outside the strict no-smoking mandate. Further, the ban extends to restrict the conduct of all persons entering the site, including subcontractors, delivery personnel, visitors and other third parties.<\/p>\n\n\n\n

Enforcement<\/strong><\/p>\n\n\n\n

There is no grace or warning period. Contractors should therefore not assume any informal transition, as enforcement is expected to begin straight away. Occupational safety officers of the Labour Department will conduct spot inspections and may issue fixed penalty notices to offenders. The government has linked the ban directly to site safety and fire-risk reduction, especially in light of concerns about smoking-related fire hazards on construction sites.<\/p>\n\n\n\n

Implications for the industry<\/strong><\/strong><\/p>\n\n\n\n

The main compliance burden will fall on principal contractors, who will need to implement and supervise a site-wide anti-smoking system capable of demonstrating that all reasonable steps have been taken.<\/p>\n\n\n\n

At present, there is limited judicial or regulatory guidance on what amounts to \u201call reasonable steps\u201d under the new regime. However, government statements suggest enforcement authorities will consider whether contractors have actively implemented and enforced measures designed to prevent smoking, rather than simply adopting written policies.<\/p>\n\n\n\n

Subcontractors should not assume that compliance is solely the principal contractor\u2019s responsibility, because those directly overseeing construction work may also be expected to play an active role in prevention, supervision, and reporting. Accordingly, all relevant units, including site managers, foremen and trade supervisors, should remain vigilant and ensure that adequate preventive measures are implemented and enforced.<\/p>\n\n\n\n

Building-maintenance teams should also take note, because some workers who do not usually think of themselves as operating on a \u201cconstruction site\u201d may still fall within the scope of the new rules when carrying out building-maintenance or renovation work.<\/p>\n\n\n\n

What workers should know<\/strong><\/strong><\/p>\n\n\n\n

Construction workers who smoke on site commit an offence and face an immediate fixed penalty of HK$3,000.<\/p>\n\n\n\n

In addition to statutory penalties, workers should be mindful that a breach of site smoking rules may lead to internal disciplinary action by their employer. Depending on the employment contract, the employer’s disciplinary procedures and the seriousness of the incident, disciplinary measures could range from warnings to dismissal in appropriate cases.<\/p>\n\n\n\n

Recommended measures<\/strong><\/strong><\/p>\n\n\n\n

Although industry bodies have begun issuing guidelines, questions are still likely to arise in practice as there does not yet appear to be a fully settled body of official guidance covering every site scenario. Contractors should therefore act conservatively and expect further clarification or guidance that may emerge from regulators or industry bodies as enforcement develops.<\/p>\n\n\n\n
