Hong Kong, 17 December 2024:<\/strong> Our Consultant John Zhou was pleased to attend a high-powered legal seminar in Hong Kong examining the broad topic of recognition and enforcement of foreign judgments.<\/p>\n\n\n\n

The five-day course, jointly organised by the Hague Academy of International Law and the Asian Academy of International Law, and held at the latter\u2019s Central headquarters, drew a diverse group of participants, including diplomats, judges, scholars and counsel.<\/p>\n\n\n\n

\u201cIt was a great pleasure joining such distinguished delegates from around the world to discuss this important area of law. Of course, the topic is particularly relevant to Hong Kong given its proximity to the Chinese Mainland and growing importance as an international centre for dispute resolution,\u201d says John.<\/p>\n\n\n\n

The gathering began with welcome remarks by Professor Jean-Marc Thouvenin, Secretary-General of the Hague Academy of International Law, and Hong Kong\u2019s Secretary for Justice Paul Lam SC. The opening lecture was given by former Secretary for Justice Teresa Cheng SC, who discussed the background to recognition and enforcement of foreign judgements, international efforts in this area and specific arrangements between Hong Kong and the Mainland.<\/p>\n\n\n\n

Adds John: \u201cThe new law facilitating the reciprocal enforcement of civil and commercial judgments by Hong Kong and Mainland courts has been in place since January and is viewed by many as a milestone in cross-border co-operation. In this regard, the seminar was valuable in helping delegates understand the benefits of the legislation and its context within broader international co-operation efforts.\u201d<\/p>\n\n\n\n

The Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance (Cap. 645) came into operation on 29<\/a> January<\/a>. The legislation reduces the need for re-litigation of the same disputes, thereby lowering the risks and saving on legal costs and time; it also offers heightened protection and predictability for parties involved in cross-border transactions.<\/p>\n\n\n\n

John, who joined BC&C in 2023, is admitted to practice law in Hong Kong, the Mainland and the New York State. He has dedicated his career to cross-border dispute resolution and has vast experience in complex commercial arbitration, litigation and compliance matters.<\/p>\n\n\n\n
