{"id":4364,"date":"2023-06-19T15:53:31","date_gmt":"2023-06-19T07:53:31","guid":{"rendered":"https:\/\/www.boasecohencollins.com\/?p=4364"},"modified":"2023-06-19T15:53:33","modified_gmt":"2023-06-19T07:53:33","slug":"under-pressure-judges-need-more-support","status":"publish","type":"post","link":"https:\/\/www.boasecohencollins.com\/zh-hant\/%e6%96%b0%e8%81%9e\/under-pressure-judges-need-more-support\/","title":{"rendered":"Under-pressure judges \u2018need more support\u2019"},"content":{"rendered":"\n<p><strong>Hong Kong, 19 June 2023:<\/strong> Judges in Hong Kong face a heavier workload than their overseas counterparts and need more assistance in delivering original and timely rulings, BC&amp;C Senior Partner Colin Cohen has told radio listeners.<\/p>\n\n\n\n<p>Colin was interviewed on RTHK Radio 3\u2019s <em>Backchat<\/em> this morning following recent revelations that High Court Judge Wilson Chan had been reprimanded by Chief Justice Andrew Cheung for copying large parts of a plaintiff\u2019s submission in his written judgment in a trademark dispute. It was not the first time the judge had faced accusations of copying.<\/p>\n\n\n\n<p>\u201cOf course, it\u2019s not satisfactory, justice must be seen to be done and the parties in a case should be given a full and thorough explanation. If the judge just repeats submissions by counsel without giving clear and concise analysis by himself, that\u2019s not right,\u201d Colin told presenters Danny Gittings and Mike Rowse.<\/p>\n\n\n\n<p>\u201cBut I\u2019ve been told by judges and magistrates that they\u2019re overwhelmed with work. That is why judgments can sometimes take months to be published. If you look at the list of hearings in the High Court today, some 40% of them are before a Deputy Judge because there are so many vacancies.\u201d<\/p>\n\n\n\n<p>Colin points to other jurisdictions where judges receive training in writing judgments and sometimes have associates to provide first drafts. \u201cThe answer to this question of copying is to recruit more judges to ease their workload and provide them with the necessary support,\u201d he concludes.<\/p>\n\n\n\n<p>Colin appeared on <em>Backchat<\/em> alongside Chinese University of Hong Kong Associate Professor of Law Sandra Marco Colino.
